Terms of Service

1. Operator

RecReach is currently operated by its founder(s) (the "Company," "we," "us," or "our"), based in Texas, United States. When a legal entity is formed, these Terms will automatically apply to that entity as successor operator.

2. Eligibility

You must:

• Be at least 18 years old
• Have legal capacity to enter into a binding agreement
• Comply with all applicable laws

The Service is not intended for minors. We may suspend or delete accounts we believe belong to users under 18.

3. Description of the Service

RecReach is a location-based discovery platform that:

• Displays nearby recreational courts and locations
• Allows users to see activity at courts
• Allows users to create profiles and share content
• Allows users to indicate interest in joining games

RecReach does not organize, host, supervise, or manage games or events; provide coaching, refereeing, or safety oversight; guarantee player conduct or skill; verify court conditions or safety; or provide transportation or equipment. All real-world activities are independently organized by users.

4. Location Data

The Service uses device location solely to provide nearby discovery features. Location is accessed only while the app is open and active. Historical location logs are not stored by us. Other users see only that you are at or near a specific court, not your exact coordinates. You may disable location permissions at any time, but some features may not function.

5. Assumption of Risk & Release

You acknowledge that recreational sports and in-person meetups involve inherent risks, including serious injury or death. You participate in all activities at your own risk. The Company is not responsible for any injury, loss, theft, or damages arising from games, meetups, or interactions with other users, and is not liable for court conditions, equipment, weather, or the actions of other users.

To the fullest extent permitted by law, you release and hold harmless the Company and its founders, affiliates, officers, and agents from all claims, liabilities, damages, and expenses arising from your use of the Service or participation in any activity discovered through the Service.

6. Accounts

You agree to provide accurate information, keep your login credentials secure, and be responsible for activity under your account. We may suspend or terminate accounts at any time for any reason, including suspected violations of these Terms.

7. User Content

You may upload content such as photos, messages, profiles, comments, and other media. You retain ownership of your content. You grant the Company a worldwide, non-exclusive, royalty-free license to host, display, modify, and distribute your content for purposes of operating and improving the Service. You represent that you have the right to share any content you upload.

8. Prohibited Conduct

You agree not to:

• Harass, threaten, or harm others
• Post illegal or infringing content
• Impersonate others
• Use the Service for unlawful purposes
• Scrape, reverse engineer, or exploit the platform
• Organize commercial events without permission

We do not tolerate objectionable content or abusive behavior. Reports of objectionable content are reviewed and acted on within 24 hours, and offending users may be removed.

9. Safety Disclaimer

We do not conduct background checks or verify identities. You are solely responsible for evaluating other users, meeting in safe public places, and using personal judgment and precautions. We recommend exercising caution when meeting anyone in person.

10. RecPoints & Rewards

The Service includes RecPoints, a free in-app rewards and points program. RecPoints and any in-app rewards have no cash value, cannot be purchased, and cannot be redeemed for money or transferred off the platform. RecPoints is not real-money gambling, wagering, or a financial product, and there is no cash-out or withdrawal of any kind. We may modify or discontinue features or programs at any time.

11. Intellectual Property

All software, designs, trademarks, and content provided by the Company are our property or licensed to us. You may not copy, modify, distribute, or create derivative works without permission. If you believe content infringes your copyright, contact us with a proper DMCA notice and we will respond as required by law.

12. Third-Party Services

The Service relies on third-party services, including:

• Apple App Store
• Google Firebase — authentication, database, storage, and cloud functions
• Google Maps
• PostHog — product analytics
• Expo — push notifications and app delivery

We are not responsible for their services or policies.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties regarding availability, accuracy, safety, reliability, or fitness for a particular purpose. Use is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the past 12 months.

15. Indemnification

You agree to indemnify and hold harmless the Company from any claims or damages arising from your use of the Service, your content, your interactions with others, or your violation of these Terms.

16. Arbitration & Class Action Waiver

Any dispute will be resolved through binding arbitration rather than court. You waive the right to a jury trial, class action lawsuits, and collective claims. Arbitration will occur in Texas under the rules of the American Arbitration Association.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.

18. Termination

We may suspend or terminate the Service or your account at any time without notice. Sections that by nature should survive termination will remain in effect.

19. Changes to Terms

We may update these Terms periodically. Continued use after changes constitutes acceptance.
